Sobriety Tests

If you have been pulled over for a DWI in Austin, you may be wondering what will happen next. Usually the officer will put you through a few routine checks to see what your BAC level is. BAC otherwise known as your Blood Alcohol Content is a ration of how much alcohol to blood you have in your system. In Texas, the legal BAC for anyone over the age of 21 is .08%. If you have anything above that, you are considered legally drunk. If you are under 21, Texas has a zero tolerance policy. This means that if you are pulled over with any type of alcohol at all, they will take you directly to jail as well as suspend your license for up to 180 days just for being a minor.

There are a couple of different types of sobriety tests. The first one is just a really basic balance test. The officer will ask you to leave your hands by your sides and lift one leg up in the air. If you lose balance or have to put your foot down because you are going to fall.

The other major sobriety test is the breathalyzer test. The officer will ask you to stand up very straight and blow into a tube that leads to a machine. This machine will use the breath and measure what your BAC is. Keep in mind that they type of gum or mouthwash you use can always affect what the breathalyzer reads.
