Jail Release

When you have just gotten pulled over and arrested, you need to find a way to get out of jail as quickly as possible. You also need to find a lawyer that can take care of your jail release as soon as the court system will allow. Jail release is a very hard thing to understand if you don't know all of the rules of the court system in your state. Texas has specific laws when it comes to getting a jail release.

When you are first arrested, the officer will take you in to the jail house and go through all of the in processing. If you have been arrested after a certain time of the night then there will not be a judge available to set a bond amount. If a judge is available then you will be taken in to see the judge so that they can decide what kind of bond you will need and how much it will cost. The lawyer that you have should be present at this hearing.

If you are arrested after 2 am, you might feel like you are going to have to stay in jail all night, but this is not true. You may be eligible for what is called a hobby release. If you are not considered to be a flight risk and give the court your word that you will appear at the court in the morning for the rest of your hearing, then the judge might be willing to give you a hobby release. A hobby release is when they release the person into the hands of their attorney on the promise that the person will show back up to court in the morning to take care of all of the legal paperwork. If you are a first time offender, it is very likely that the court will let you go that same night.
