Punishment for DWI in the State of Texas



First Offense:

  • 72 hours to 190 days in jail
  • maximum fine $2,000
  • driver’s license suspension: 90 days to 1 year

Second Offense:

  • 30 days to 1 year in jail
  • maximum fine $4,000
  • driver’s license suspension: 180 days to 2 years

Third Offense:

  • 2 to 10 years in penitentiary
  • maximum fine of $10,000
  • driver’s license suspension: 180 days to 2 years

Under 21 and in possession of alcohol, First offense:

  • driver’s license suspension: 30 days
  • maximum fine of $500
  • 8 to 12 hours of community service
  • attendance in alcohol awareness classes
If you’re older than 17, penalties can be as high as a $2,000 fine and 180 days in jail for a third offense. If you are under 21, and are pulled over for drinking and driving, the penalties will be similar to those above regardless of the amount of alcohol in your system. However, the amount of days for the driver’s license suspension and hours for community service will be doubled. If you exceed .08 BAC and are 17 or older, the discipline will be similar to a regular first offender.
