DWI Penalties for Repeat Offenders

Texas has one of the highest DWI rates in the country; about five people are killed every day in an alcohol-related car accident in our state. In an attempt to combat this, Texas law has strict repercussions for people who drive drunk, especially if they are repeat offenders. For a second offense, the penalty effectively doubles: the maximum fine goes from $2,000 to $4,000, while the maximum prison sentence increases from 180 days to one year.

When a person is convicted of their second DWI offense, in addition to possible fines and jail time, they will probably be required to take an educational course. These courses can be held in a variety of legal, religious and educational settings, provided the course leader has been licensed by the state. The course may last from 12 to 30 hours total, and will cover such topics and drug abuse and dependency, safe driving, and improving self esteem in order to increase motivation to drive safely and avoid drug abuse.

Even after your first offense, a judge may also order you to undergo evaluation for alcohol dependency. This is a separate sentence from the courses described above, which are generally sentenced to all repeat offenders regardless of their emotional health. If a person is determined to have a drinking problem, they may be offered the chance to attend a rehab program or support group in lieu of a longer sentence in jail. Being arrested for a second DWI offense carries an automatic sentence of at least 72 hours of jail time.
